1. Overview
This website and the Your Memorables service are operated by Moda Home, trading under the brand Your Memorables (“Your Memorables”, “we”, “us”, or “our”).
Throughout these Terms of Service (“Terms”), the terms “you” and “your” refer to any person who accesses our website, places an order, uploads content, purchases our products, or otherwise uses our services.
These Terms apply to your use of our website, online ordering services, photo upload services, event ordering systems, and other services provided by Your Memorables.
By accessing our website, submitting an order, uploading content, or purchasing a product from us, you agree to be bound by these Terms.
If you do not agree to these Terms, you should not use our services.
2. Our Services
Your Memorables provides personalised and custom photo products, including photo magnets and other customised products.
Depending on the service, customers may be able to:

crop, position, rotate, or adjust images;

select product layouts, quantities, frames, or other options;

provide contact and delivery information;

place orders online or at participating locations or events;

We reserve the right to modify, suspend, discontinue, or replace any part of our services at any time.
3. Orders
When you place an order, you are responsible for ensuring that all information submitted is accurate and complete.
This includes, where applicable:

cropping and positioning;

quantity;

personalisation options;

delivery or collection information; and

payment information.
Submitting an order does not necessarily mean that we have accepted it.
We reserve the right to reject or cancel an order where reasonably necessary, including where:

payment cannot be confirmed;

incorrect pricing or product information was displayed;

an uploaded image cannot reasonably be produced;

the order contains prohibited or unlawful content;

fraud or misuse is suspected;

production is not possible due to technical or operational reasons; or

a product or service is unavailable.
If we cancel a paid order that we are unable to fulfil, we will provide an appropriate refund where applicable.
4. Personalised and Custom Products
Many Your Memorables products are made specifically using photographs, images, text, layouts, or other content provided or approved by the customer.
Before completing an order, you are responsible for reviewing your selected images, cropping, orientation, quantity, layout, spelling, and other customisation details.
The final printed product may differ slightly from what appears on a phone, computer, or other digital display.
Differences may occur due to:

screen brightness and calibration;

colour profiles;
-
printing processes;
-
photographic paper or materials;
-
image resolution;
-
cropping;
-
aspect ratio;
-
lighting conditions; and
-
normal production tolerances.
Minor differences of this nature do not normally constitute a defect.
5. Customer-Uploaded Images and Content
You retain ownership of photographs and other content that you upload to our services.
By uploading or submitting content to Your Memorables, you grant us a limited permission to store, process, resize, crop, adjust, reproduce, print, and otherwise process that content solely as reasonably necessary to provide the requested service, fulfil your order, provide customer support, and operate our systems.
You represent and warrant that you have the necessary rights or permission to use and submit any content you upload.
You must not upload content that:

infringes another person's intellectual property rights;

violates another person's privacy or other legal rights;

is unlawful;
-
contains malicious software or code;
-
is submitted for fraudulent or abusive purposes; or

would cause us to violate applicable law.
We reserve the right to reject or remove content that we reasonably believe violates these Terms or applicable law.
6. Image Quality
The quality of a finished personalised product depends significantly on the quality of the image supplied by the customer.
Low-resolution, blurred, compressed, dark, overexposed, cropped, or otherwise poor-quality source images may result in reduced print quality.
Where our services provide cropping, positioning, image enhancement, colour adjustment, or similar tools, these features are intended to assist with preparing an image for production but cannot guarantee that a low-quality source image will produce a high-quality result.
Customers are responsible for reviewing the available preview before confirming an order.
7. Pricing
Prices are displayed in the applicable currency and may vary depending on the product, quantity, package, promotion, location, event, fulfilment method, or other options selected.
We reserve the right to change prices at any time before an order is confirmed.
Promotional prices, package prices, discounts, and special offers may be subject to additional conditions and may be changed or withdrawn at any time unless otherwise stated.
If an obvious pricing or calculation error occurs, we reserve the right to correct the error before fulfilling the affected order. If payment has already been made, we will contact you where reasonably necessary and provide an appropriate refund if the order cannot be fulfilled at the correct price.
8. Payments
Available payment methods may vary depending on the website, location, event, merchant, or sales channel.
Payment may be processed by third-party payment service providers.
By using a third-party payment method, you may also be subject to the terms and privacy policies of the relevant payment provider.

Because many of our products are personalised or custom-made, an order may not be eligible for cancellation, return, exchange, or refund once production has started, except where required by applicable law or where the product is defective or incorrect due to an error on our part.
If you believe that you have received a defective, damaged, or incorrect product, please contact us as soon as reasonably possible and provide your order details and relevant photographs where requested.
Eligibility for refunds, replacements, or other remedies will be assessed according to the circumstances of the order and applicable law.

Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded under applicable consumer protection laws.

Unless otherwise stated, the Your Memorables website, branding, logos, software, interfaces, graphics, designs, text, and other materials provided by us are owned by or licensed to Your Memorables and are protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, sell, license, reverse engineer, or commercially exploit our materials except where permitted by law or with our prior written permission.
This section does not transfer ownership of customer-uploaded photographs or content to us.
13. Acceptable Use
You must not use our website or services:

We do not guarantee that every digital image will reproduce identically in physical print, particularly where differences result from the customer's source image, display characteristics, or normal printing tolerances.
18. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Moda Home, Your Memorables, and their respective employees, representatives, contractors, and service providers from claims arising directly from:

content you submit in violation of these Terms;

your infringement of another person's rights;

your unlawful use of our services; or

your material breach of these Terms.
19. Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
